By accessing or using FluidConvert ("the Service"), operated at fluidconvert.com, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Description of Service

FluidConvert provides an online file conversion platform that allows users to convert files between various formats including video, audio, image, document, and archive formats. The Service is available as a free tier with limitations and paid subscription plans with expanded capabilities.

3. User Accounts

You may use certain features of the Service without creating an account. To access additional features, you may create an account by providing accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You agree to notify us immediately of any unauthorized use of your account. We reserve the right to suspend or terminate accounts that violate these terms.

4. Free and Paid Plans

Pro Plan ($9/month)

• Maximum file size: 1GB per file
• Up to 100 conversions per day
• Priority processing speed
• No advertisements

Business Plan ($29/month)

• Maximum file size: 5GB per file
• Unlimited conversions
• Fastest processing speed
• API access and priority support

5. Payments and Billing

Paid subscriptions are billed monthly through Stripe. By subscribing to a paid plan, you authorize us to charge your payment method on a recurring basis. You may cancel your subscription at any time, and you will retain access to paid features until the end of your current billing period.

We reserve the right to change our pricing with 30 days' notice. Price changes will not affect your current billing period.

6. Acceptable Use

You agree not to use the Service to:

• Upload, convert, or distribute files that contain illegal content
• Infringe on any intellectual property rights or copyrights
• Upload files containing malware, viruses, or harmful code
• Attempt to circumvent usage limits or security measures
• Use automated tools to access the Service without permission
• Resell or redistribute the Service without authorization
• Interfere with or disrupt the Service or its infrastructure

We reserve the right to remove any content and suspend or terminate accounts that violate these terms without notice.

7. Intellectual Property

You retain all ownership rights to the files you upload and convert using our Service. We do not claim any ownership over your content. By uploading files, you grant us a temporary, limited license to process your files solely for the purpose of providing the conversion service.

The FluidConvert name, logo, website design, and all associated branding are the property of FluidConvert and may not be used without our written permission.

8. File Handling

Files uploaded for conversion are temporarily stored on secure servers and are automatically deleted within 24 hours. We do not access, review, or share the contents of your files. While we take reasonable measures to protect your files during processing, we recommend keeping backups of your original files.

9. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Service will be uninterrupted, error-free, or secure, or that conversions will be 100% accurate in all cases. Conversion quality may vary depending on the source file format and content.

10. Limitation of Liability

To the maximum extent permitted by law, FluidConvert shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or business interruption, arising out of or in connection with your use of the Service.

Our total liability for any claim arising from the Service shall not exceed the amount you paid us in the twelve months preceding the claim, or $100, whichever is greater.

11. Indemnification

You agree to indemnify and hold harmless FluidConvert and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Service, your violation of these terms, or your infringement of any third-party rights.

12. Termination

We may terminate or suspend your access to the Service at any time, with or without cause, with or without notice. Upon termination, your right to use the Service ceases immediately. You may delete your account at any time through your account settings.

13. Changes to Terms

We reserve the right to modify these Terms of Service at any time. We will notify users of material changes by posting the updated terms on this page and updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the revised terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any disputes arising from these terms shall be resolved in the courts of competent jurisdiction.
